1. Scope of warranty

1.1 Listan GmbH (hereinafter referred to as “Listan”) guarantees its customers (refers to end customers who purchase to products and are not engaged in the sales of goods) that the products purchased - covered by the respective warranty - are without material and manufacturing defects. This warranty does not affect the statutory warranty rights that may be invoked free of charge, but rather establishes additional, independent claims against Listan. 

1.2 The warranty only extends to the Listan products as specified in the warranty list. Said warranty shall be provided in such a manner that the parts which demonstrably exhibit faults on account of material and manufacturing defects despite being handled and used in accordance with the instructions for use will be replaced or repaired free of charge at our discretion. Alternatively, we shall reserve the right to refund the purchase price against return of the defective device or component or, in the case of devices or components no longer manufactured, to replace the defective device or component with one having similar functions and performance or to refund the residual value (purchase price divided by the warranty period in years multiplied by the full years of the remaining warranty period). Devices that have been replaced shall become our property. Any software and manuals that may have been supplied are excluded from the warranty (this does not apply to goods with digital elements, i.e. goods that contain or are connected to digital products in such a way that the goods would not be able to fulfil their functions without these digital products). Return shipment to the customer shall be at Listan’s expense. Not included in the warranty is compensation for any installation and removal costs as well as for indirect damage, consequential damage and loss of profit.

1.3 The warranty shall apply only to end customers (consumers) who purchase new products from retailers or system integrators. It is not assignable, except where prohibited by applicable local law.

1.4 We shall be entitled to make technical modifications (e.g., firmware updates) which extend beyond repair and exchange in order to keep the device up-to-date with the current state of technology. The buyer will incur no additional costs for this service. Although, the customer cannot derive legal claims from this article.

2. Warranty period

The warranty period for the affected Listan products is listed on the following warranty list and is calculated from the date on the purchase receipt (If the product has been sold multiple times, only base on the date that the first purchasing receipt of the product what issued by retailer or system integrator). Warranties shall neither affect an extension of the warranty period nor trigger a new warranty. The warranty period for installed replacement parts shall end upon the end of the warranty period for the end device. 

3. Processing

3.1 Warranty claims shall only then be taken into consideration if a copy of the original invoice or the purchase receipt is submitted together with a description of the flaw along with the device to Listan. The purchasing receipt must indicate the date of purchase, model name and complete company data of the retailer or system integrator including the tax number or VAT ID. The information provided must be complete and clearly legible.

3.2 It is imperative that the warranty processing is handled directly by Listan or Listan‘s authorized distributor. Warranty claims processed by a dealer without authorized distributor or Listan's approval will not be accepted by Listan. In cases of warranty claims erroneously processed through a dealer, the customer bears the risks of performance failure by the dealer (such as due to insolvency). 

3.3 The customer should forward the device concerned to the following address for warranty processing:

3.4 In order to rapidly process warranty claims, the following steps are required:

  • The customer contacts Listan via online form or telephone support through the respective phone number provided, having the documents available mentioned in 3.1.
  • The customer now sends the faulty product (without any accessories) and the documents mentioned in 3.1 to Listan where the warranty claim is promptly reviewed and processed. Freight collect transmissions will be returned to the customer without being processed. The end customer will bear the costs of the transport to Listan.
  • Following completion of the inspection, Listan will either replace or repair the product or refund the purchase price or the residual value and, to the extent that the purchase price or residual value is not merely refunded, return the product to the customer at Listan's expense. Should it be established that there is no warranty case (see point 4: Exclusion of the warranty), the product sent in will be returned along with a detailed test report, but without the product having been repaired.

4. Exclusion of the warranty

4.1 Even the product is within warranty period, following warranty claims are excluded

  • If the device was damaged or destroyed through the effects of force majeure or environmental influences (humidity, heat, electric shock, excessive workloads, dust and the like)
  • If the device was stored or operated under conditions which do not adhere to the technical specifications described on the product schedule.
  • If the damage was caused through improper handling.
  • If the device was opened, repaired or modified without approval.
  • If the device has mechanical damage of any kind.
  • If the serial number sticker is removed or not readable (only for PSU, watercoolers and cases).
  • With regards to individual components which are subjected to usage-related or other natural wear-and-tear.

4.2 Partially or completely disassembled or manipulated products may not be presented or sent in as a warranty claim.

5. Servicing errors

If the defect has been caused by the installation of third-party products (software installation, viruses, etc.), then we reserve the right to bill the buyer for any expenditures incurred as well as to reject the warranty claims.

6. Express exchange service (Germany and France only)

6.1 Besides the above warranty procedure, Listan also offers its customers (end users) a free express exchange service for products listed in the product selection with “Express exchange service in the 1st year”. This service is only applicable to products purchased from a specialist dealer or system integrator in Germany or in France and is restricted to the national territory of both countries. Only the original consumer purchaser is entitled to the express exchange service. This service is only valid up to 12 months from the date of the proof of purchase.

6.2 Processing of the application:

a.) Please have a copy of your sales receipt, a brief description of the error, the serial number of the power supply and a billing and shipping address ready.

b.) Within 24 hours (excluding Saturday, Sunday and public holidays) after receipt of all documents a replacement device will be sent out to you. If we receive your service request before 2 p.m., the replacement device will be sent out on the same day. In principle, you will receive the model that is the subject of the complaint as an exchange. In the case of stock shortage, we reserve the right to provide you with a higher-quality power supply.

c.) You will receive a return slip for your old device at the same time as the replacement device. Please return this to us free of charge within 14 days of submitting your application. Please note that we will have to charge you for the newly sent power supply if you do not return the old power supply on time.

d.) Your old device will be checked by us for the error described. We reserve the right to charge a processing fee of 49€ if the described error cannot be reproduced during this examination and no defect can be detected.

6.3 Since October 1st 2015, the terms and conditions of the express exchange service apply to the 48h on-site exchange service.

6.4 In all other respects, the regular warranty conditions apply.

7. Supplemental provisions

7.1 The above terms and conditions conclusively regulate the prerequisites for the warranty service. It shall be governed by the laws of the Federal Republic of Germany. Any mandatory legal provisions (regulations) in force at the place of purchase (initial purchase by the original end consumer) shall remain unaffected by these warranty conditions.

7.2 Any more extensive claims as such for the availment of warranties shall not be substantiated through these warranty terms and conditions.

7.3 These warranty conditions shall apply to all be quiet! products as of 1.10.2022.
